حد ودکی اقسام

حد ودکی اقسام
حدود کو مندرجہ ذیل دو حصوں میں تقسیم کیا جاتا ہے:
1۔معاملات میں حدود
اس قسم میں معاشرت ، معیشت ، نکاح، طلاق، کھانے پینے ، رہن سہن اور دیگر معاملات میں حدود مقرر کی گئی ہیں جیسا کہ علامہ زبیدی لکھتے ہیں
"فَحُدُودُ اللّهِ عزّ وجلّ ضَرْبَانِ ضَرْبٌ منها حُدودٌ !حدَّها للنّاسِ في مَطَاعِمِهم ومَشارِبِهم ومَنَاكِحِهِم وغيرها ممّا أَحَلّ وحَرَّم"۔ 58
"حدود اللہ کی دو اقسام ہیں۔ ایک تو ایسی حدود جو لوگوں کے لیے ان کے ماکولات ، مشروبات اور مناکحات وغیرہ میں بسبب حلال اور حرام متعین کی گئی ہیں ۔ "
قرآن مجید میں انہی معاملات کے بارے میں آیا ہے، جیسا کہ اس آیت مبارکہ میں حرام مال کا تذکرہ کر کے اسے کھانے سے منع فرمایا جا رہا ہے :
﴿ِ إنَّ الَّذِينَ يَأْكُلُونَ أَمْوَالَ الْيَتَامَى ظُلْمًا إِنَّمَا يَأْكُلُونَ فِي بُطُونِهِمْ نَارًا وَسَيَصْلَوْنَ سَعِيرًا۔ ﴾59
"بے شک جو لوگ یتیموں کا مال ناجائز طور پر کھاتے ہیں وہ اپنے پیٹوں میں آگ بھرتے ہیں اور دوزخ میں ڈالے جائیں گے۔ "
اس آیت مبارکہ میں نکاح کے بارے میں فرمایا کہ اپنی ماں سے نکاح نہیں ہوتا۔
﴿وَلَا تَنْكِحُوا مَا نَكَحَ آَبَاؤُكُمْ مِنَ النِّسَاءِ إِلَّا مَا قَدْ سَلَفَ إِنَّهُ كَانَ فَاحِشَةً وَمَقْتًا وَسَاءَ سَبِيلًا۔ ﴾60
"اور جن عورتوں سے تمہارے باپ نے نکاح کیا ہو ان سے نکاح مت کرنا مگر(جاہلیت میں ) جو ہو چکا (سو ہو چکا) بے شک یہ نہایت بے حیائی اور (اللہ کی) ناخوشی کی بات تھی اور بہت برا طریقہ تھا۔ "
2۔ عقوبات میں حدود
ایسی سزائیں جو اللہ اور اس کے رسولﷺ نے بعض جرائم پر مقرر فرمائی ہیں۔ یہ حدود کی دوسری قسم ہے۔ ان عقوبات سے متعلق ابن منظور تحریر کرتے ہیں
"والضَّرْب الثانِي عُقوباتٌ جُعِلَتْ لمنْ رَكِبَ ما نَهَى عنْه ، كحَدّ السّارِق"61

Media has wide spectrum in modern world such that it is known as fourth pillar of state. Media has made convenient and has provided numerous facilities. Apart from this media also has shortcoming. Media has wide application in modern world and it is used for different purposes but it has influenced the field of business significantly. In field of business there are various methods to advertise their products and goods but the role of media cannot be neglected nowadays. The owners of industries and factories find it the most suitable ways of enhancing the sale of their products and goods. Therefore advertising has become the most profitable and productive source of income because every company spend a huge amount in order to advertise their products. The Islam has allowed the human being to widen their business through fair means but it is necessary to analyze the Islamic and moral perspective of advertisement so that Muslims may know about the limitation of issue and under its constraints they can be benefited. In this article we will elaborate the Islamic significance and limitations of advertising.

Peace Through Rule of Law: A Community Law Literacy Perspective, Proposed Model for Pakistan

The basic drive behind this research, is the everyday problems of lawlessness faced by people of Pakistan on roads, in markets and offices and virtually all around them. The behavior of people towards discipline and compliance is distressingly indifferent. The indifference is shared equally by the so-called literates and illiterates. In more civilized societies, law-literacy is interwoven into literacy that makes people aware of the rules of conduct and requires them to own and internalize these rules. Compliance becomes the spontaneous response of these people and a strong culture of lawfulness results. The research, initially, aims at qualitatively determining the reasons why literacy is producing different results in Pakistan as compared with England and Norway. It is observed that in Pakistan, academic literacy is assumed to be meant for careers and not for social and cultural training. The result is that social side of learning remains cosmetic and lacks internalization according to the spirit of norms and law. A weak culture of lawfulness is the outcome. The research further postulates that a weak culture of lawfulness occupies a lower position on the scale of rule of law. On the other hand, global data shows that countries better on the scale of rule of law are better in terms of peace in society. It points out a causal relationship between law literacy, culture of lawfulness, rule of law and peace. To find out relationship between all four factors the research invites quantitative analysis that determines a significant causal relationship among law literacy, culture of lawfulness, rule of law and peace. Presumably, a wellplanned community law literacy program by utilizing all three channels of literacy i.e. formal, non-formal and informal could positively steer culture of lawfulness, rule of law, and peace. By utilizing the findings of this rigorous research comprising qualitative and quantitative analyses, an executable community law literacy model is proposed for Pakistan to enable people to internalize culture of lawfulness wherefrom rule of law and peace would causally sprout. Application of social marketing theory is recommended for short term results and for long term change of mindset, DewyFreirean fused method of teaching is suggested to be utilized to fully implement the proposed model.
