Legal experts and economists advocate that the century-old debt-equity distinction is responsible for the global financial crisis (GFC) and instability.This regulation advocates and subsidizes debt (unlike equity financing) as tax deductible.This regulation, in turn, reduces the cost of debt financing and eludes debt as a relatively cheap source of financing. Later, theoretical developments related to corporate financing policies explicitly materialized interest tax deductibility and advocated debt over equity financing.Researchers have highlighted the need to reframe these debt subsidizing corporate tax regulations.This thesis offers a critical analysis of debtincentivized corporate tax and financing policies and provides an Islamic perspective on this vital tax deductibility debate.This study aims to help abolish the corporate tax incentive to debt and shift the incentive toward equity. This study also attempts to empirically test the implications of proposed interest taxability and dividend tax deductibility on corporate financing policies. This thesis estimates a modified Modigliani and Miller (1963), (later M & M) firm valuation model to incorporate interest taxability and dividend tax deductibility.The estimated model is linear and static to the single period t.This thesis uses a simulation technique to evaluate the estimated model and conducts various policy experiments to observe the potential impacts of proposed policy reforms on a firm’s cost of capital and overall value.The simulated results indicate that, in the presence of debt tax incentives, firms lose value over every subsequent unit of debt financing.Zero-leverage firms, in the presence of the interest tax shield, may stabilize their value.The present study finds that aligning a corporate financing policy with the fundamentals of Islamic finance helps restrain corporate indebtedness and promote profit and loss sharing.According to the proposed model, firms have a reduced cost of financing, tend to be more stable, and are valueoriented, especially when they avoid debt to the maximum extent.The results indicate that minimum debt financing in the presence of a dividend tax shield reduces firms’ costs of financial distress and their proneness to bankruptcy.Islamic finance can provide a corporate financing model for sustainable and equitable wealth creation.

سخت افسوس ہے ۶؍ ستمبر کویوپی گورنمنٹ کے سب سے زیادہ سنیئر آئی سی ایس، ممبرریونیو بورڈ سیدصدیق حسن صاحب نے اچانک داعیِ اجل کولبیک کہا اور اس دنیا سے رخصت ہوگئے۔انتقال سے صرف پانچ روز پہلے یعنی یکم ستمبر کو عصر کی نماز کے بعد دارالعلوم ندوۃ العلماء لکھنؤ کی مجلسِ انتظامیہ کاجلسہ تھا، مرحوم سے وہاں ملاقات ہوئی،حسب عادت بڑے تپاک اور گرم جوشی سے ملے۔ جلسہ کے اختتام پر ہم سب کے ساتھ مسجد ندوہ میں مغرب کی نماز پڑھی، باہر نکلے توراقم الحروف اوردوسرے حضرات کے ساتھ دس پندرہ منٹ بات چیت کرتے رہے اور پھر مولانا عبدالماجدصاحب دریابادی کواپنے ساتھ لے کر کارمیں بیٹھ کر رخصت ہوگئے۔ اس وقت دیکھنے میں کافی تندرست اور ہشاش بشاش تھے اوراس بات کا وہم وگمان بھی نہیں ہوسکتا تھا کہ بس اب عالمِ آب وگِل میں پانچ دن کے مہمان ہیں۔ پاکستان میں ایک قریبی عزیز کاانتقال ہوگیاتھا، اُن کی تعزیت کرنے کی غرض سے اپنی بیوی اور بیٹی کے ساتھ لاہور جارہے تھے ،امرتسر پہنچ کر کسٹم وغیرہ کے مراحل سے گزرنے کے لیے ایک متعلق افسر کی میز کے سامنے جاکر کھڑے ہوئے اور جیب سے پاسپورٹ نکال کرافسر مذکور کی طرف بڑھارہے تھے کہ وقتِ موعود آپہنچا ،یک بیک دل کی حرکت بندہوگئی اور دھڑام سے زمین پر گر پڑے ، لوگوں نے دیکھا تومرغِ روح قفسِ عنصری سے پرواز کر چکا تھا۔ ’’انا ﷲ وانا الیہ راجعون ‘‘۔

موقف إلحاق الورق النقدي بالفلوس: دراسة فقهية نقدية

Paper currency has remained controversial since its advent, until the majority of the modern scholars agreed that paper currency is just like gold and silver, and all the rules and provisions regarding the/of homogeneous and heterogeneous exchange of gold and silver are applicable to paper currency. This viewpoint is widely adopted by prominent modern-day international academies of Islamic Jurisprudence and the same has been preferred by the majority of contemporary scholars in their books, dissertations and scholarly articles. On the contrary, there is a different opinion of majority of the scholars in Indian sub-continent. The reason behind this was that the viewpoint of Ḥanafi school of thought about legal effective cause (᾽illat) of Ribā i.e. Weight is not found in paper currency, so the rules of Ṣarf (Exchange of gold and silver) are inapplicable. So, they opined that paper currency is like Fulūs (metal coins). Furthermore, to stop all the possible ways resulting to/in Ribā according to this opinion, they preferred the viewpoint of Imam Muhammad (R.A) regarding the metal coins and set some precautionary measures. However, the said standpoint has not been deliberated and contested in the contemporary jurisprudential research work as it deserved. This research aims to evaluate this viewpoint in detail, clarifying its roots and evidences while revealing its implications and comparing it with the view adopted by the majority of the contemporary scholars.

Exploring New Dimensions in Public-Private Partnership in Education

The study conceptualized Public-Private Partnership in education and reviewed current research in this area to identify and analyse PPP programmes in global perspective. The review of literature included experiences and lessons learnt from different programmes. Objectives of the study were to clarify the concept and current status of PPP in education and analyse the existing initiatives of Public-Private Partnerships in education, before exploring new dimensions and models of PPP that could be integrated into the mainstream education system of Khyber Pakhtunkhwa, province of Pakistan. The study was carried out in five districts of Khyber Pakhtunkhwa. Population of the study consisted of 240 teachers associated with PPC programme, 240 experts on PPP subject, 120 boys‟ secondary school principals/heads and 120 principals/heads of PPC institutions. The study chose stratified random sampling technique. The sample was divided into four groups: principals/heads boys‟ secondary schools, principals/heads PPC institutions, PPC teachers and experts on PPP subject. The primary source of data collection was a uniform opinionnaire for all the respondents. The secondary sources of data included study of office documents, dissertations, internet and library sources and literature review. The analysis of data was given both quantitative and qualitative treatment. The results were validated with the help of statistical measures. The current PPP initiatives in Pakistan were reviewed. They include „Adopt a School‟ programme, „Non-formal School Programme‟, „Adult Literacy Initiatives‟, „Concessions to Private Schools‟, „Up- gradation of Schools through Community Participation Project‟, „School Management Committees‟, „Citizen Community Boards‟, „Tawana Pakistan Programme‟, „Education Voucher Scheme‟, „Foundation Assisted Schools‟, „Continuous Professional Development Programme‟, „Teaching in Clusters by Subject Specialists‟, „Fellowship Programme‟, „Community Supported School Programme‟, „Home School Programme‟ and „Community Based School Programme‟. The study found a wide range of PPP in education provision the world over, each with different characteristics, design features and country context. The global PPP models included „Private Finance Initiatives‟ (UK), „The New Schools Project‟ (Australia), „The Offenbach Schools‟ (Germany), Moral Persuasion Model‟ (South Africa), „The JF Oyster Bilingual Elementary School‟ (USA) vi and many others. It was discovered that there is a dire need for introducing PPP in education. The indicators for readiness to get into PPP include political will and support of government; willingness of all parties involved in education and regulatory measures by government, the placement of a clear communication strategy at all levels, formulation of an in-built mechanism for conflict resolution, allocation of adequate funds by government, formulation of an accountability mechanism for all partners, ensuring accountability and transparency, involvement of community in consultative processes, development of generic guidelines by government for identification of private partners and development of monitoring and evaluation tools. The study made three dimensional recommendations: firstly, recommendations for improving and reforming the PPP initiatives; secondly, recommendations regarding new dimensions in PPP; and thirdly, suggestions for integrating them in the mainstream education system of Khyber Pakhtunkhwa. General recommendations were adoption of a clear policy on PPP in education, engaging private providers in the delivery of educational services; promotion and facilitation of financial contribution and investments by development partners and individual philanthropists through different schemes of PPP, strengthening of PPC through good policy design, careful implementation and effective management for replication and sustainability. Furthermore, formulation of a regulatory framework to streamline the PPP affairs, development of transparent terms and conditions of partnership, clear and objectively streamlined criteria and processes to prevent monopoly of either partner for smooth functioning of PPP programmes, establishment of appropriate performance measures in PPP contracts and ensuring experience, competence, team capacity and effectiveness of the contracting agency, provision of safeguards against commercialization and privatization of education in disguise of publicprivate partnership and establishment of a PPP-Management Information System at provincial level. The study also explored new dimensions and models of PPP for integration in the mainstream education system of the province. They included „Adopt a School‟ programme (Sindh Pakistan); „Private Finance Initiative‟ (UK); The New Schools Project‟ (Australia); „Moral Persuasion Approach‟ (South Africa); „The JF Oyster Bilingual Elementary School‟ (USA) and „Charter Schools‟ (USA).
