Orientalism is an ancient tradition of Western scholarship which portrays Islam, Muslim societies and Arabs in negative manner. Orientalist tradition was extended to Islamic legal scholarship during colonial era. Ground breaking publication of a Hungarian orientalist Ignac Goldziher (d.1921) `Introduction to Islamic Theology and Law' (1910) became the basis of all future writings on this subject. Joseph Schacht (d.1969) a German orientalist carried his work in Goldziher's footsteps and published `Origins of Mohammadan Jurisprudence' (1950) and 'An Introduction to Islamic law' (1964) which laid the foundations of Islamic legal orientalism in academic writings of the Western world. With the advent of orientalist tradition in USA during the Cold War era, leading American universities established Oriental Studies, Near Eastern Languages and Cultures and Middle Eastern Studies departments which worked closely with U.S. State department and Foreign Affairs department to facilitate the goverhment to establish political hegemony over the Middle East and the Muslim world. Two major assumptions put forward in the academic debate by the West on 'Origins' of Islamic law were inauthenticity of hadith literature and influence of pre-Islamic non-Arab laws on the development of Islamic law. This dissertation carries out critical analysis of writings of Western scholars during cold war era through post 9/11 era to date, on these two issues. The objective of this research is to study the shift in paradigms, trends, approaches and methodology adopted by Western scholars of 21' century in their writings on Origins of Islamic law and to see how this scholarship is related to European and American political hegemony over the Muslim world. Writings of Harald Motzki, Jonathan Brown, Wael Hallaq and Patricia Crone and a few more are selected to analyze 21' century Western scholarship. Responses, rebuttals and critiques on the assumptions put forward by Western scholars of 20th century are also part of this dissertation. A shift in trend and methodology is observed in 2l' century Western scholarship on Islamic law but the essential paradigms for the study remain the same thus putting forth similar results. It is also observed that Western scholarship on Islam is strongly connected with its political hegemony over the Muslim world. Methodologically Western scholarship has shifted from 20th century philological zeitgeist to 21' century social science research but it remains within the orientalist problematique. Thus Islamic law is portrayed as an essentially defective legal system and hadith literature the second primary source of Islamic law remains inauthentic in Western scholarship. However there are scholars who are aware of the fact that they are not to become hostage to biased paradigms and inadvertent commitments to political agendas in order to promote academic honesty.

An Existential Anthropological Study of Selfhood, Uncertainty and Resilience Among Youth of Tando Ghulam Ali, Sindh

This study combines three orientations, namely existential thought about the meaning of ‘being’ and ‘existence, ’ phenomenological insights into ‘lived experience, ’ and anthropological endeavor at what it means to be human. It attempts to focus on the human conditions by directly engaging with human beings. Specifically guiding itself with the questions such as how young people engage in the meaning-making of their lived experiences in their life course’s ever-changing process. Taking its theoretical insights and inspiration from existential and phenomenological anthropology, by zooming in on lived experiences, the research was conducted using life story interviews to collect the narratives to gain understandings into the life-worlds as it is lived and made sense of by young people of Tando Ghulam Ali, a rural town of District Badin, Sindh. Based on the ethnographic data and observations, it is argued that the meaning-making of lived experiences was different among research participants with a strong presence of selfhood and self-consciousness temporally and affectively; the difference in orientation towards life is entangled with personal history as well. This research went beyond the horizons of culture and society to put existence, life, and being, which are silhouetted at meta-level, at the heart of anthropological focus. This research is an experimental research project in anthropology, which has attempted to step its foot into the human condition's terra incognita, which calls for anthropologists’ further exploration.

An Analytical Study of Wahbah Al-Zuhaylis Thought in Contemporary Islamic Jurisprudence

This dissertation aims at exploring the process of transmissionlearning and its impacts on the development of the ʻUlemā- the insightful scholastic class of Islam- with a special focus on the verbalization of Islamic orders. The bottom rock of this study is the academic of the twentieth century, Wahbah Muṣṭafā Zuḥaylī (1932-2015) who has extensively and substantially enriched the Islamic laws and legal jurisprudence through many of his speeches and books which deal broadly with various ramifications of Islamic cultures. His teachings are relevant to the whole Muslim world in general and to the Middle East in particular. He argues that religious compulsion to follow the Sunnī diktats is not compulsory for the faithful. He further maintains that the followers of Sunnī Islam are free to follow any of the four validated Sunni edicts, and even this is not compulsory as long as one follows a competent Islamic jurist. Heeven goesto the extent of permitting the people to follow the rules of other laws as long as they are not against the fundamental instructions of Islam. Zuḥaylī is of the opinion that relationships between Muslims and non-Muslims should be based on mutual respect, brotherhood, and universal understanding. He considers war only as a weapon of last resort. The first chapter of the dissertation is a prologue to al-Zuḥaylī. It embodies the social and scholarly ether of his time. The second chapterevaluates the diverse course of history through which the Islamic Law developed from the time of Holy Prophet صلى الله عليه وسلمdown to the current time. Third chapterscrutinizes the methodology of al-Zuḥaylī. The main focus of this chapter remains on how he has adopted the reason-based and otherworldly techniques to deal with the information inside the Islamic family law. Fourth chapterexplores al-Zuḥaylī‘s contribution on the laws of Islamic Business and Monetary Exchanges in the light of contemporary rules on business and monetary administration. Fifth and Sixth chapters discuss the chosen contemporary issues to comprehend Zuḥaylī‘s abilities to find solutions for the current issues. The conclusion of the dissertation encompasses the brief analysis of the over-all impacts of the writer on Islamic Law.
