سابق مدرس اعلیٰ دارالعلوم ندوہ
حضرت مولانا ابوالحسنات عبدالحئی صاحب فرنگی محلی کی آخری یادگار مٹ گئی یعنی ان کے آخری شاگرد یعنی مولانا محمد حفیظ اﷲ صاحب، جو ان کی مجلس درس کی اکیلی یادگار رہ گئے تھے، ۱۳۶۲؁ھ کے خاتمۂ ماہ میں وفات پاگئے۔
مرحوم ۱۸۵۶؁ء کے آخر میں ضلع اعظم گڑھ کے چھوٹے سے گاؤں بندی میں پیدا ہوئے تھے، غدر ۱۸۵۷؁ء میں وہ ۶ ماہ کے تھے اور اسی قدر وہ مولانا شبلی نعمانی سے بڑے تھے، ابتدائی کتابیں گھر پر پڑھ کر وہ اپنے عزیز مولانا سلامت اﷲ صاحب جیراجپوری (والد حافظ اسلم صاحب جیراجپوری) کے ہمراہ بنارس تعلیم کے لئے گئے، وہاں سے واپس آکر مدرسہ چشمۂ رحمت غازی پور میں پڑھنے کے لئے گئے، وہاں فارسی کی اونچی کتابیں پڑھیں، اس زمانہ میں غازی پور میں حضرت مولانا عبدالحلیم صاحب فرنگی محلی کے شاگرد رشید مولانا غلام جیلانی صاحب تھے، ان سے باصرار عربی کتابیں شروع کیں اور چند سال میں ان سے متوسطات تک پڑھ کر انہی کے مشورہ سے فرنگی محلی لکھنؤ میں مولانا ابولحسنات عبدالحئی صاحب فرنگی محلی کی مجلس درس میں حاضر ہوئے، یہ وہ زمانہ تھا، جب داروغہ حیدربخش کی مسجد جو چوک میں عربی اور طب پڑھے والوں کا گویا دارالاقامۃ تھا، نئی بن کر تیار ہوئی تھی، چنانچہ حضرت مولانا عبدالحئی صاحب کی سفارش سے ان کو اس کے حجرہ میں رہنے کی جگہ ملی، اور یہاں کئی سال رہ کر معقولات اور دینیات کی تعلیم حاصل کی، فراغت کے بعد جو غالباً ۱۸۸۰؁ء میں ہوئی ہوگی وہ کاکوری ضلع لکھنؤ کے ایک مقامی مدرسہ میں مدرس مقرر ہوئے، یہی سلسلہ ہے جس سے وہ جناب منشی احتشام علی مرحوم رئیس کاکوری سے ملے، کہ پھر ان کے دل الگ نہ ہوئے اگلے زمانہ میں دوستوں...

Authoritative Position of Investor and Scope of Liability in Modarabah Contract: Classical and Contemporary Jurists Perspective

The position of investor is always questioned once capital is handed over to a working partner (Mudarib). The concerns of investor along with series of liabilities cannot be ignored because Modarabah losses are always transferred or born by him/her. The study highlights the authoritative position of Investor and suggests that investor has full access to impose conditions on Mudarib to safeguard his interest as per shariah rulings. The study debates investor’s position to impose geographical restrictions to restrict the scope of trade, trade policy of working partner (Mudarib) and fixation of time.  Besides, the study discourses the concept of limited liability in context of Islamic law where creditors hold right to personal wealth of the debtors.

Including the Excluded: A Case Study of an Inclusive Classroom in an Inclusive Education School in Karachi, Pakistan

The purpose of inclusive education is to value children with special needs, so that they can participate equally in all educational activities in a general school along with their peers without discrimination. There is a worldwide movement towards establishing inclusive educational settings for children who have not as yet received due attention from governments and the private sector. The Salamanca Conference (1994) focused on education of the child with special education needs. In this gathering, all governments of the world were to ensure the basic education of all children with and without special education needs (SEN) within the existing mainstream schools. Many developed countries have already worked on this critical issue. In the developing countries, much less initiatives have been taken to include children with SEN in the mainstream schooling systems. As a result, there is a dearth of research in this area (with the exception of studies on teachers' attitudes), and where efforts (have been) made, they lack enough support, direction and clarity towards inclusive education. In Pakistan, as in many other developing counties, the government has given more attention to the inclusion of girl child in the main stream educational system, as compared to inclusion of the child with SEN. Despite these difficulties, I found a private school in Karachi, Pakistan, which has taken initiatives for implement a policy of inclusion of all children in their school. This study set out to find the perceptions, classroom practices, interactions, facilitating and hindering factors within an inclusive classroom and their relationship with the practical steps that can be taken towards inclusive education. The study was a case study, where in- depth interviews and classroom observations were conducted. The class had three students with SEN, and the remaining 22 students had no special needs. It was found that the participants (teachers, co-ordinator, and principal) had positive attitudes towards inclusion. They perceived that inclusive education (IE) allows all children to share the same school and classroom. There was a two-sided interaction (negative and positive) between perceptions and practices. The study also found that more students with SEN could be accommodated in mainstream classroom than the current number through the existing practice, for example, students having physical handicaps or mild impairments are not particularly disruptive to the classroom.
